1. Acceptance of Terms

By creating an account and using ResQ Bites Corp. ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Platform.

2. Platform Description

ResQ Bites Corp. is a marketplace connecting restaurants with surplus food to buyers seeking discounted meals. The Platform facilitates the listing, discovery, and ordering of surplus meals but does not prepare, handle, or deliver food.

3. Buyer Responsibilities & Liability

• Buyers acknowledge that meals are surplus/overstock items and may vary from descriptions.
• Buyers are responsible for reviewing listed allergens and making informed decisions regarding food allergies and dietary restrictions.
• ResQ Bites Corp. is not liable for any illness, allergic reaction, or adverse effect resulting from the consumption of purchased meals.
• Buyers assume all risk associated with consuming surplus food items.
• Mystery bags contain random items at the restaurant's discretion; no refunds for mystery bag contents.
• Orders must be picked up during the pickup window established by the restaurant. Failure to pick up an order during the established pickup window will result in the forfeiture of the ordered item, without refund.
• All sales are final. Once an order is placed and payment is confirmed, the order cannot be cancelled, modified, or refunded. No refunds or cancellations are permitted after order confirmation under any circumstances.

4. Restaurant (Seller) Responsibilities & Liability

• Restaurants must accurately list known allergens present in their meals.
• Restaurants are solely responsible for the safety, quality, and accurate description of meals listed.
• Restaurants must comply with all applicable food safety regulations and health codes.
• Restaurants agree to honor confirmed orders and have meals ready during the stated pickup window.
• Sale prices must not exceed the original retail price and must reflect a discount of at least 40%.

5. Fees & Payment

• The Platform is free to join for both buyers and restaurants.
• A service fee of $1.00 per order is charged to the buyer.
• ResQ Bites Corp. retains 30% of each meal's sale price as a platform commission.
• Restaurants receive 70% of the sale price for each completed order.
• All prices are in USD.

6. Limitation of Liability

ResQ Bites Corp. acts solely as a marketplace platform. We do not inspect, prepare, or guarantee the quality or safety of any food items. To the fullest extent permitted by law, ResQ Bites Corp. shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or consumption of meals purchased through it.

7. Service Area

ResQ Bites Corp. is expanding to connect restaurants and diners across new communities. Availability of listings and orders may vary by location.

8. Account Termination

ResQ Bites Corp. reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or repeatedly receive complaints regarding food quality or safety.

9. Changes to Terms

ResQ Bites Corp. may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
