Licenses & Regulatory Compliance
Last Updated: 10/12/2026
This page summarizes the licenses and regulatory requirements relevant to operating the ResQ Bites marketplace in Canada and the United States.
1. Platform-Level Requirements
- Business registration: incorporation federally or in a Canadian province, or as an entity in a U.S. state, with a registered business name.
- Tax registration: a business number for tax purposes in Canada (CRA) and a federal tax ID (EIN) in the U.S.
- Privacy compliance: PIPEDA in Canada and applicable U.S. state privacy laws, supported by our Privacy Policy.
- Anti-spam compliance: Canada's Anti-Spam Law (CASL) and U.S. CAN-SPAM rules govern our transactional and promotional emails.
2. Sales Tax Obligations
- Many U.S. states have marketplace facilitator laws that can require a marketplace to collect and remit sales tax on behalf of sellers. We calculate and display applicable taxes at checkout based on the restaurant's location.
- In Canada, GST/HST (and provincial sales taxes such as PST and QST) may apply to food sales and platform fees depending on the province and the item sold.
- Restaurants remain responsible for their own tax reporting and remittance to the extent not handled by the Platform.
3. Payment Processing & Payouts
- Payments are processed by Stripe, a PCI-DSS Level 1 certified provider; we never store full card numbers.
- The Platform does not hold customer funds beyond processing transactions and disbursing each restaurant's share of completed orders.
- Restaurants receive 70% of each sale price, paid out by the method selected in their account.
4. Restaurant Partner Requirements
Each restaurant partner is responsible for holding, and remaining in good standing with, the licenses applicable to food service in its jurisdiction, which typically include:
- A valid food service or public health permit and passing health inspections.
- A municipal business license for the premises.
- Food handler certification where required by the province or state.
- Compliance with commercial liability insurance requirements where applicable.
Restaurants must also disclose known allergens on every listing, follow safe food-handling practices, and comply with date-labelling rules (for example, in Canada "best before" dates are quality indicators, not safety cutoffs, while food past an expiration date must not be sold).
5. Platform Verification
We review each restaurant's registration details before its listings go live and may suspend or remove a restaurant whose licenses lapse or that receives repeated food-safety complaints. Verification status is tracked in the Platform's records.
6. Buyers
No special license is required to purchase meals. Buyers must follow pickup instructions, respect pickup windows, and comply with any conditions the restaurant communicates at pickup.
7. Questions
For questions about this page or to provide license documentation, contact us through the Platform's support chat or email.
